Section 7: the FTC deception theory

Is this legally binding?

Binding, sectoral. Binding, but only for a defined population: one regulated sector, or the federal government and the vendors it buys from.

Directs the FTC to issue a policy statement explaining when a state law requiring alterations to truthful AI outputs is preempted by the FTC Act's prohibition on deceptive acts. The FTC published a proposed statement on 1 July 2026.
