Right of publicity

A legal protection, defined at the US state level rather than federally, giving an individual control over the commercial use of their name, image, voice, and likeness. Distinct from and additional to copyright; a dataset can clear a copyright acquisition-ladder check while still carrying right-of-publicity exposure if it includes an identifiable person's voice or likeness.

Defined in 4 GAGE programs, which carry 5 distinct definitions of it. The wording above is taught in AI Data Governance: The Data Chair.

How each discipline defines it

The same term does different work depending on who is using it. These are the definitions as each program teaches them, unedited.

AI Data Governance: The Data Chair

A legal protection, defined at the US state level rather than federally, giving an individual control over the commercial use of their name, image, voice, and likeness. Distinct from and additional to copyright; a dataset can clear a copyright acquisition-ladder check while still carrying right-of-publicity exposure if it includes an identifiable person's voice or likeness.

Senior AI Scam Defense

The general legal category, existing in some form in most states, that protects a person's name, voice, and likeness from unauthorized commercial use by others; state laws addressing AI voice cloning and digital replicas, including Tennessee's ELVIS Act, are recent extensions of this older legal tradition to specifically cover AI-generated reproductions.

AI Literacy & Professional Conduct

A person's legal right to control commercial use of their own likeness and voice. It exists independently of copyright and of AI-disclosure rules, so cloning a real person's face or voice requires their consent regardless of whether the output is labeled as AI.

AI Governance: Applied Mastery

A person's right, recognized in many jurisdictions, to control the commercial use of their name, image, and voice. AI-generated endorsements, cloned voices, and synthetic likenesses can infringe it independently of copyright.

Senior AI Scam Defense

A legal doctrine that protects a person's name, image, likeness, and, since the ELVIS Act, voice, from unauthorized commercial or otherwise prohibited use by someone else, giving the person a legal claim against the unauthorized use.
