Article 6(3) filter

The provision allowing a provider to conclude that an Annex III system is not high-risk, where it does not materially influence decision-making and one of four conditions applies (narrow procedural task, improving a completed human activity, pattern detection without replacing human review, or preparatory task). The filter is overridden if the system performs profiling of natural persons.

Defined in 2 GAGE programs, which carry 3 distinct definitions of it. The wording above is taught in EU AI Act Implementation Expert.

How each discipline defines it

The same term does different work depending on who is using it. These are the definitions as each program teaches them, unedited.

EU AI Act Implementation Expert

The provision allowing a provider to conclude that an Annex III system is not high-risk, where it does not materially influence decision-making and one of four conditions applies (narrow procedural task, improving a completed human activity, pattern detection without replacing human review, or preparatory task). The filter is overridden if the system performs profiling of natural persons.

AI Governance: Applied Mastery

The narrow exit by which an Annex III system is not high-risk if it poses no significant risk to fundamental rights and performs only a narrow procedural, confirmatory (improves prior human work), pattern-detecting (without replacing human assessment), or preparatory task. The exit is cumulative and narrow, and it is closed by the profiling override.

EU AI Act Implementation Expert

The derogation under Article 6(3) allowing an Annex III system to be classified as not-high-risk if it does not pose a significant risk and satisfies one of four conditions (narrow procedural task, improving a completed human activity, detecting patterns without influencing the prior assessment, or preparatory task). Cannot apply if the system performs profiling of natural persons.
