AI Act enforcement in Netherlands

Netherlands has proposed an AI Act authority in draft legislation but has not completed designation. 1 AI enforcement action has been recorded there, carrying 30.5 million euro in confirmed fines. The Article 5 prohibitions bind in Netherlands regardless, and have since 2 February 2025.

The state of play in Netherlands

The Autoriteit Persoonsgegevens and the RDI are proposed as coordinating authorities. Designation is not complete, and the AP has been one of the most active authorities against AI systems under the GDPR.

The deadline in Article 70 for member states to designate their national competent authorities was 2 August 2025. Designation in national law and notification of a single point of contact to the Commission are separate steps, and this register tracks the first.     Enforces the GDPR in the Netherlands and publishes a recurring algorithmic risk report.

    Maximum penalty: 20 million euro or 4 percent of worldwide annual turnover (GDPR Article 83)
