The enforcement surface of the Act
Every enforceable provision, and what it costs
The EU AI Act is enforced through three national penalty tiers under Article 99 and one Commission tier under Article 101. Article 5 prohibited practices carry up to 35 million euro or 7 percent of worldwide turnover. Providers of general purpose AI models face 15 million euro or 3 percent, from the Commission, not from a member state.

Get this right
The 7 percent figure does not apply to AI model providers
The single most repeated error about the AI Act is attaching the 35 million euro or 7 percent ceiling to a foundation model provider. That figure is Article 99(3). It is the tier for prohibited practices under Article 5, and it is enforced by national market surveillance authorities against whoever puts a prohibited system on the market.
A provider of a general purpose AI model answers to the Commission under Article 101, where the ceiling is 15 million euro or 3 percent of worldwide turnover. Both figures are real and both are in the same regulation. Quoting the wrong one in a briefing is the fastest way to tell a reader you have not read the Act.
