AI Act enforcement in Spain
Spain has designated its AI Act market surveillance authority in national law. No AI enforcement action has been recorded there on this tracker. The Article 5 prohibitions bind in Spain regardless, and have since 2 February 2025.

The state of play in Spain
AESIA, created by Royal Decree 729/2023, is the first purpose built AI supervisory agency in Europe.
The deadline in Article 70 for member states to designate their national competent authorities was 2 August 2025. Designation in national law and notification of a single point of contact to the Commission are separate steps, and this register tracks the first. See the full register for how Spain compares.

Agencia Española de Supervisión de la Inteligencia Artificial
Spain's market surveillance authority for AI systems, a purpose built agency rather than a role added to an existing regulator.
Maximum penalty: 35 million euro or 7 percent of worldwide turnover for prohibited practices (AI Act Article 99(3))
