AI Act enforcement in Italy

Italy has designated its AI Act market surveillance authority in national law. 9 AI enforcement actions have been recorded there, carrying 25.21 million euro in confirmed fines. The Article 5 prohibitions bind in Italy regardless, and have since 2 February 2025.

The state of play in Italy

Law 132/2025 designates ACN for market surveillance and AgID for notification. The Garante remains the authority that has actually taken action against AI systems.

The deadline in Article 70 for member states to designate their national competent authorities was 2 August 2025. Designation in national law and notification of a single point of contact to the Commission are separate steps, and this register tracks the first. See the full register for how Italy compares.

  • Garante per la protezione dei dati personali

    Enforces the GDPR in Italy. By a distance the most active European authority on AI systems, and the first to cite an AI Act prohibition in a published decision.

    Maximum penalty: 20 million euro or 4 percent of worldwide annual turnover (GDPR Article 83)

  • Agenzia per la Cybersicurezza Nazionale

    Italy's market surveillance authority for AI systems, sitting alongside the Garante, which continues to enforce the GDPR against the same systems.

    Maximum penalty: 35 million euro or 7 percent of worldwide turnover for prohibited practices (AI Act Article 99(3))
