The revised EU product liability rules make software a product and reach a robot that changes after it is sold
Directive (EU) 2024/2853 replaces the 1985 product liability regime. Its definition of product covers software, so the code and the model inside a robot are in scope, and member states had to transpose it by 9 December 2026. Defectiveness is judged including the effect of learning and of updates under the manufacturer's control.

- Article 4(1): product means all movables, even if integrated into or inter connected with another movable or an immovable, and it includes electricity, digital manufacturing files, raw materials and software.
- Article 22(1): member states shall bring into force the measures necessary to comply with the Directive by 9 December 2026.
- The Directive applies to products placed on the market after that transposition date; older products stay under the 1985 regime.

For a robot maker or a deployer
Your software release process is now a liability surface. A model update that changes how a robot behaves sits inside the product you placed on the market, and the burden a claimant carries is lighter than in the old regime. Keep the version history, the training and validation record and the field reports for every fleet, because the file you can produce years later is the only defence that survives.
