Open question: is a fleet wide behaviour update a new placing on the market?

EU product law is built around the moment a product is placed on the market, and a robot fleet can change behaviour overnight by update. The Machinery Regulation treats substantial modification as a trigger, the AI Act speaks of significant change to the design, and no instrument says plainly when a model update makes the machine a new product.

  • The Machinery Regulation applies to machinery placed on the market from 14 January 2027 and treats a substantially modified machine as a new product.
  • As amended, AI Act Article 111(2) makes operators of pre existing high risk systems comply only if the systems are subject to significant changes in their designs after the date of application.
  • Neither instrument states whether retraining or a policy update delivered over the air is such a change.

For a robot maker or a deployer

Decide your own threshold before a regulator decides it for you: write down which classes of update you treat as a substantial modification, what re assessment each triggers, and how you record it. That policy is defensible even if the answer moves, and an update log with no policy behind it is not.
