The EU Machinery Regulation applies from 14 January 2027 and puts self evolving safety functions in the third party lane

Regulation (EU) 2023/1230 replaces the Machinery Directive from 14 January 2027. Annex I Part A lists safety components with fully or partially self evolving behaviour using machine learning approaches, and machinery embedding such systems, so a robot whose safety function learns leaves the self certification lane and takes third party conformity assessment.

  • Article 54: the Regulation shall apply from 14 January 2027, with earlier dates for the notified body and delegated act provisions.
  • Article 51(2): Directive 2006/42/EC is repealed with effect from 14 January 2027, and references to it are read against the correlation table in Annex XII.
  • Annex I Part A points 5 and 6 name safety components with fully or partially self evolving behaviour using machine learning approaches ensuring safety functions, and machinery embedding such systems.
  • Recital 55 limits the third party route to systems with fully or partially self evolving behaviour; software that cannot learn or evolve stays outside it.

If any safety function of your robot learns or evolves after it leaves the factory, your conformity route changes: a notified body, not your own declaration, closes the file, and the clock is 14 January 2027. Read your product against Annex I Part A points 5 and 6 first, because the answer decides the cost and the lead time of every later model.
