EU product safety law already names learning and predictive functions as a safety factor for consumer robots

Regulation (EU) 2023/988 has applied since 13 December 2024 and catches consumer products that no sectoral law fully covers. Article 6(1)(h) puts the evolving, learning and predictive functionalities of a product among the factors that decide whether it is safe, which reaches a home robot long before the AI Act machinery route bites.

  • Article 6(1)(h): when required by the nature of the product, the evolving, learning and predictive functionalities of the product are a factor in assessing safety.
  • Article 2(1): the Regulation applies where no specific provisions with the same objective under Union law regulate the safety of the products concerned, and only to the risks not covered by those requirements.
  • Article 52: the Regulation shall apply from 13 December 2024, and Article 50 repeals the old General Product Safety Directive from the same date.

For a robot maker or a deployer

If you sell a robot to households, this is the rule that already applies to you, today, whatever the AI Act timetable says. Your risk assessment has to answer what the product learns and how its behaviour can drift, and your recall plan has to work when the drift shows up in the field. Treat an over the air behaviour change as a product safety event, not just an engineering release.
