The Digital Omnibus took AI enabled machinery out of the AI Act high risk lane and handed it to the Machinery Regulation
Regulation (EU) 2026/1744 deletes point 1 of Annex I Section A of the AI Act, the entry that named the old Machinery Directive, and adds the Machinery Regulation to Section B. For those machines only Article 6(1), Articles 102 to 109 and Article 112 of the AI Act apply, while machinery law absorbs the high risk requirements through delegated acts.

- Omnibus Article 1 point 41: in Annex I, Section A, point 1 is deleted, and Section B gains point 21, Regulation (EU) 2023/1230 on machinery.
- AI Act Article 2(2): for high risk systems related to products covered by Section B of Annex I, only Article 6(1), Articles 102 to 109 and Article 112 apply.
- Omnibus Article 2 adds a duty on the Commission to amend Annex III of the Machinery Regulation with health and safety requirements reflecting AI Act Chapter III Section 2 and Articles 17, 19, 72 and 73.
- Omnibus Article 1 point 40 resets Article 113: Annex III high risk rules from 2 December 2027, Annex I high risk rules from 2 August 2028.
- Before this amendment Annex I Section A point 1 named Directive 2006/42/EC, not Regulation (EU) 2023/1230, which is why older guidance still cites the Directive.

What it changes
For a robot maker or a deployer
If you build robots for the EU, the compliance target moved. You are no longer preparing two parallel files, one for the AI Act and one for machinery: you are preparing one machinery file that will carry AI requirements inside it, and the date that matters for the AI layer is 2 August 2028 rather than 2 August 2027. Anyone still planning against Annex I Section A point 1 and the old Machinery Directive is planning against a deleted line.
