Open question: should a data center's water use be public, site by site

Europe collects site level water figures and keeps them confidential. United States bills would route them to states and to local governments on request. Malaysia steers supply without publishing draws. No jurisdiction in this atlas publishes a per site water figure as a matter of course, and nobody has argued the case in public.

  • S. 4213 would require monthly water use and source to go to a state, and to be made available to an affected unit of local government on request.
  • Georgia SB 421 would attack the confidentiality agreement rather than create a reporting duty.
  • The commercial confidentiality argument and the community interest argument have never been tested against each other in a published decision found by this build.

For an operator, a utility or a community

An operator choosing to publish a site figure voluntarily would be first, and would set the comparison everyone else is measured against. A utility holding consumption data should know whether its own state treats it as confidential before promising either way. A community should ask for the figure and record the refusal, because the refusals are what will decide this question.
